Multiple prior DUI convictions or DUI accidents causing serious bodily injury or death can raise the misdemeanor DUI charge to a felony crime thereby exposing the accused to potential prison time.

Mitchell A. Stone, P.A., has developed proven strategies to assist clients facing felony DUI charges. He will challenge the evidence and deploy legal, factual and procedural defenses to seek dismissal of charges or the reduction of felony charges to a misdemeanor. Mitch Stone is always prepared to take any DUI case to trial if necessary. He has conducted over 100 criminal DUI jury trials to verdict and has consistently achieved favorable results for clients in these difficult cases.

DUI Accidents Causing Death Or Serious Bodily Injury

DUI Accidents can result in more serious charges with more serious consequences:

  • DUI Causing Property Damage — up to one year in jail.
  • Multiple DUIs — three convictions within a 10-year period, or four DUIs in a lifetime, punishable by up to five years in prison.
  • DUI resulting in serious bodily injury — up to five years in prison.
  • DUI manslaughter — causing death due to driving while impaired by alcohol or drugs, is punishable by a minimum mandatory of four years and up to 15 years in a state prison.
  • Vehicular homicide — driving recklessly and causing a death punishable by up to 30 years.

Driving on a suspended license can also be a felony, if the illegal driving resulted in a serious injury accident while the driver was suspended for a previous DUI or if the driver has prior multiple license suspension convictions.

In addition to prison and a felony criminal record, felony DUI can result in license revocation of several years to life. Permanent revocation offers no opportunity for a hardship license in many cases

Mitch Stone has 30 years of specific experience in DUI law. After prosecuting these type cases as an Assistant State Attorney he has spent the past 25 years honing his skills in DUI defense. He has a historical record of success stories too numerous to list that resulted in dropped charges, dismissed cases, jury acquittals and reduced charges that enabled our clients to avoid the harsh consequences of a felony DUI. From challenges to the traffic stop, to the real meaning of roadside sobriety tests and the validity of blood or breath samples, Stone has established errors or civil rights violations by police that led to favorable results for clients.
